2016-01-25 - HOERBIGER denies TESLA claims

Zug, January 25, 2016 – On January 19, 2016 a complaint was filed in the United States District Court, San Jose, California, on behalf of Tesla Motors, Inc. against HOERBIGER Automotive Comfort Systems LLC, Auburn, Alabama. The claim implies that Tesla ended its relationship with HOERBIGER because HOERBIGER failed to fulfill the specified requirements for the hydraulic actuation system for the Tesla Model X "Falcon Wing" doors.

HOERBIGER strongly rejects this statement.

Tesla Motors, Inc. repudiated its agreements with HOERBIGER in May 2015. By this point in time, HOERBIGER Automotive Comfort Systems was already fully prepared to begin high-volume production according to Tesla’s most current schedule.

HOERBIGER was in compliance with the specifications stipulated by Tesla Motors, Inc.. That´s why, after Tesla’s repudiation, HOERBIGER was in negotiations with Tesla regarding reasonable compensation for costs related to design and engineering, executive, engineering and production personnel, materials supply, and production capacity, including contractual obligations to HOERBIGER´s suppliers.

Media reports implying HOERBIGER was responsible for the design of the Tesla Model X doors are misleading. From the beginning, HOERBIGER was only tasked with the development and production of the hydraulic door actuation system. HOERBIGER was never responsible for the electronic controls associated with symmetry and overheating problems cited in the complaint.
